These Terms & Conditions ("Terms") explain the basis on which Archipelago may be used. They form an agreement between users and Archipelago, so they should be read before continuing. By using any part of the Service, acceptance of these Terms is assumed. If there is anything within these Terms that is not acceptable, the appropriate course is simply not to use the Service.

In these Terms, "Archipelago" refers to the publisher of this website and its associated newsletters, applications and online services (together, the "Service"). "You" and "your" refer to anyone who visits, reads, registers with, contributes to or otherwise uses the Service.

1. Who these Terms cover

These Terms apply to everyone who uses the Service, including casual readers, newsletter subscribers, registered users and contributors.

The Terms apply each time the Service is used and sit alongside the related documents below, which together govern the relationship between users and Archipelago:

2. Who can use Archipelago

The Service may only be used by individuals who are legally able to enter into binding agreements under applicable law, and only where such use is lawful.

The Service is intended for individuals aged 16 or over. Those under the age of 16 should not register for an account or submit personal information through the Service, although reading access remains available.

Archipelago is published from the United Kingdom and is written primarily for UK and international travel audiences. No representation is made that the Service, or any part of it, is suitable or available in other jurisdictions.

Anyone accessing the Service from outside the United Kingdom does so on their own initiative and remains responsible for compliance with local laws.

3. Accounts

Some areas of the Service may now or in future require account registration.

Where an account is created, users agree to provide accurate and complete information, keep that information current and maintain the confidentiality of login details.

Responsibility for activity occurring through an account remains with the account holder, whether authorised or not. If unauthorised access is suspected, Archipelago should be informed promptly.

Accounts may be suspended, restricted or closed where there is a reasonable belief that these Terms have been breached, or where this is necessary to protect the Service or other users. Where fair and practical, notice will be given.

4. Using the Service responsibly

The Service must not be used in any way that:

  • Breaks the law or involves dishonest, misleading or fraudulent activity

  • Is defamatory, abusive, harassing, threatening, hateful or discriminatory

  • Infringes privacy, data protection rights, intellectual property rights or other rights

  • Is obscene, sexually explicit or otherwise seriously offensive

  • Distributes spam, malware or harmful code

  • Attempts unauthorised access to systems, accounts or data

  • Interferes with or undermines the operation or security of the Service

  • Harvests or scrapes content or data, or uses bots, crawlers or automated means without permission

  • Misrepresents identity or affiliations

The security and integrity of the Service are taken seriously. Suspected misuse may be investigated and appropriate action may be taken, including removing content, restricting features or suspending accounts.

5. Content submitted by users

Users may be able to submit comments, messages, images or other material ("Your Content").

Ownership of Your Content remains with the individual submitting it. By submitting content, a worldwide, non-exclusive, royalty-free licence is granted to Archipelago, including the right to sublicense, use, store, copy, adapt, publish, display and distribute that content for the purposes of operating, promoting and improving the Service.

This licence permits actions such as displaying comments beneath articles, including content in related features and maintaining the normal operation of the Service. Ownership is not transferred.

By submitting content, users confirm that:

  • The content belongs to them or they otherwise have the right to submit it and grant the licence above

  • The content does not break the law or infringe anyone else's rights

  • Any description of a place, business or experience reflects a genuine and honest opinion

UK law treats fake, paid-for or otherwise inauthentic reviews as prohibited practices, and such material will not be hosted.

Archipelago is not required to publish or retain submitted content and reserves the right to edit, refuse, remove or restrict access where content breaches these Terms, is unlawful or is otherwise unsuitable.

If content is removed and a review is requested, contact may be made through the routes described in section 7.

6. Archipelago content and permitted use

Everything made available through the Service, including articles, guides, photographs, illustrations, video, graphics, page designs, code, the Archipelago name and associated branding ("Archipelago Content"), is protected by copyright, trade mark and intellectual property laws and belongs either to Archipelago or its licensors.

Archipelago Content may be read, shared and used for normal personal, non-commercial purposes. Content must not otherwise be copied, reproduced, republished, adapted, translated, sold or commercially exploited without written permission. Copyright notices, trade marks and ownership notices must not be removed or altered.

7. Reporting content and copyright complaints

If content on the Service is believed to be unlawful, to breach these Terms or to infringe rights, this should be reported through the Corrections page with sufficient detail for investigation. Archipelago respects intellectual property rights and expects the same from users.

Claims relating to copyright or other rights should include enough information to identify the material and the relevant right so that appropriate action can be taken.

8. Links, third-party content and affiliate relationships

The Service contains links to external websites, tools and content not controlled by Archipelago.

These links are provided because they may be useful and should not be interpreted as endorsements of all material contained on those services. Responsibility is not accepted for their content, availability, accuracy or practices.

When leaving Archipelago and using another website, interactions become subject to that website's own Terms and Conditions and Privacy Policy.

9. Paid features and pricing

Most content published by Archipelago is available free of charge. Where paid features are offered, pricing and included services will be made clear before purchase and will generally be displayed in pounds sterling (£), unless stated otherwise.

Any unavoidable charges will be included within displayed prices in accordance with UK consumer law. Nothing in these Terms removes rights available under consumer law, including rights relating to refunds and digital content standards.

These documents form part of the agreement relating to use of the Service.

11. Availability and accuracy

Archipelago aims to maintain reliable service and accurate content but provides the Service on an "as available" and "as is" basis.

No guarantee is provided that the Service will always remain available, uninterrupted or error-free.

Travel content is researched and written in good faith and is intended as general editorial information rather than legal, financial, medical, safety or professional advice. If you would like to request changes, then please us the Corrections page.

Travel conditions, pricing, visa requirements, opening times and regulations frequently change, sometimes with little notice. Current information should always be confirmed through official sources.

Nothing within this section affects consumer rights protected by law.

12. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

This includes liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any matter that cannot legally be excluded or limited

Subject to applicable law:

  • Liability does not extend to losses that were not reasonably foreseeable or arose outside reasonable control

  • Liability does not extend to business losses where the Service is used commercially

  • General editorial content should not be relied upon without independently checking current information

Consumer rights remain unaffected.

13. User responsibilities

Where the Service is used for business purposes, responsibility may arise for reasonable claims, losses or costs resulting from breaches of these Terms, misuse of the Service, submitted content or unlawful conduct. This does not apply to private consumer use.

14. Suspending or ending access

Use of the Service may end at any time at the user's discretion. Archipelago may suspend or withdraw access where these Terms are breached or where legal, operational or security reasons require it. Sections intended to continue after termination remain in force.

15. Changes to these Terms

These Terms may be updated periodically to reflect changes to the Service or legal requirements. The most recent version will always be available, with the date indicating when updates occurred.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. Where significant changes occur, reasonable steps will be taken to make users aware of them.

16. Feedback

Feedback, suggestions and ideas submitted regarding the Service may be used freely by Archipelago without compensation or additional obligations. This does not affect ownership rights relating to user-submitted content under section 5.

17. General

These Terms, together with referenced documents, constitute the complete agreement relating to use of the Service.

If any provision becomes invalid or unenforceable, remaining provisions continue to apply. Failure to enforce a right immediately does not mean that right has been waived.

Rights and obligations may be transferred to another organisation if Archipelago is reorganised, without affecting user rights. Users may not transfer rights without agreement.

Persons not party to these Terms have no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

18. Governing law and jurisdiction

These Terms and disputes arising from them are governed by the laws of England and Wales. Consumers living elsewhere within the United Kingdom may also retain rights to bring proceedings within their own jurisdiction, and consumer protections available under applicable law remain unaffected.
